CANBERRA, Aug 14 AAP - The federal government has accused Opposition Leader Tony Abbott
of endangering Australia's foreign investment framework by backing the right of farmers
to deny miners access to their land.

"If you're going to upend the whole way of doing business in Australia here in the
mining sector I wouldn't do it some reckless, risky thought bubble, Assistant Treasurer
Bill Shorten told ABC Television on Sunday.

Mr Shorten was responding to comments Mr Abbott made on Friday, but was reluctant to
repeat when quizzed by reporters in Perth on Saturday.

Mr Abbott agreed farmers had "a right to say no" if they did not want miners to come
onto their land to explore for energy and mineral deposits.

"I'm surprised that he has put such a, to be blunt, sovereign risk in investment in
Australia on the table," Mr Shorten said.

But the opposition leader's stance was backed by another senior coalition figure at the weekend.

Queensland LNP leader Campbell Newman has accused the Bligh government of allowing
coal seam gas projects to grow at breakneck speed to prop up their budget without concern
for farmers and the environment.

He also pledged to ban open cut coal mining in prime agricultural land in the Darling
Downs, west of Brisbane, and the central Queensland's grain growing region, known as the
Golden Triangle.

The UN climate panel has issued its strongest warning yet that human activities are
causing global warming that may bring more drought, heatwaves and rising seas.

The panel's report .. due for formal release today .. bolsters conclusions from a 2001 study.

The new report may put pressure on governments and companies to do more to curb greenhouse
gases mainly from burning fossil fuels in power plants, factories and cars.

Delegates say scientists and government officials in the Intergovernmental Panel on
Climate Change .. the most authoritative group on global warming .. agree it's 90 per
cent probable that human activities are the main cause of warming in the past 50 years.



Education Bishop (BRISBANE)

Federal Education Minister JULIE BISHOP wants state and territory governments to work
together to standardise core high school subjects.

Ms BISHOP says she'll put a plan to state education ministers when they meet in April.

Speaking at a luncheon of the Committee for Economic Development of Australia yesterday
.. Ms BISHOP said Australia should be raising the bar in education .. not lowering it
so that all can pass.

A comparative analysis of Year 12 standards shows some high school students are highly
successful academically .. but a growing number don't have the fundamental skills to get
a job.



Water (GOOLWA)

Prime Minister JOHN HOWARD is appealing to state premiers to support his government's
10 billion dollar plan to fix the Murray Darling basin .. saying it's the only salvation
for the ailing waterways.

Mr HOWARD'S plan has already been rejected by South Australian Premier MIKE RANN ..

but Victorian and New South Wales leaders say they'll consider the rescue package.

South Australian Premier MIKE RANN says he's confident he can reach a compromise with
the prime minister on the future management of the Murray-Darling basin.

JOHN HOWARD yesterday travelled to the mouth of the Murray River at Coorong .. south
of Adelaide .. appealing to state premiers to accept a federal takeover of the Murray-Darling.

Mr RANN wants the river system to be managed by a commission of independent experts
.. saying he's willing to compromise .. provided the new management model safeguards the
interests of his state.



Water Qld (BRISBANE)

The Queensland government says it's prepared to force belligerent local councils in
the state's south-east to accept recycled effluent for drinking.

The Caloundra City Council on the Sunshine Coast says while it's willing to pump purified
waste water to parched Brisbane .. it's not willing to be on the receiving end.

The state government says the south-east will be drinking treated sewage by the end
of next year if the drought continues .. whether residents want to or not.



Hicks Letter (CANBERRA)

Democrats .. Labor .. and Greens MPs .. have written to the Democratic Party speaker
of the US Congress .. NANCY PELOSI .. asking for help in bringing home Guantanamo detainee
DAVID HICKS.

The letter .. authored by Democrats leader Senator LYN ALLISON .. has been signed by
all Democrats .. Greens and almost all members of the Labor party.

Their letter states the US military commission process to try HICKS and other Guantanamo
Bay prisoners runs against basic American values.

HICKS' lawyers also claim the Australian was shown a photo of SADDAM HUSSEIN hanging
from a rope after his execution.

19 April 2011 - German online tyre trader Delticom (ETR:DEX) today reported a preliminary consolidated net profit of EUR4.2m (USD5.98m) for the first quarter of 2011, slightly up from EUR4m booked a year earlier.
Earnings before interest and tax (EBIT) increased by 4.6% on the year to EUR6.1m, while EBIT-margin fell to 7.2% from 7.9% registered in the first quarter of 2009.

The company's sales volume was initially weaker as compared with the prior-year period due to a lower snowfall this winter, Delticom said. In addition, this year's Easter falls in the second half of April.

The company's revenue went up 14.6% in annual terms to EUR85.4m in the first three months of 2011.

Delticom will release a detailed financial report for the first quarter on 10 May 2011.

ACACHE contains a lot of things. So a Norwegian daily says it has received a cache of some 250,000 US diplomatic cables from around the world, which will see us reading into leaks well into the end of next year. Previously Wikileak materials were funnelled only to selected newspapers, called media partners. The British Guardian is one, The New York Times another, and then there's the German Des Spiegel. Now it seems there are more leaks to Wikileaking. So has the tittle-tattle of diplomatic observers been dished out that it fills a whole ginormous flagon, to be poured into selected funnels as time and reason admit.

There are many things that make Wikileaks such fascinating reading, not least the way Wikileaks have been drip-drip-dripping into our newspapers. We don't know what else is there nor why Wikileaks has chosen to work through the mainstream media whilst also purporting to be the alternative, exasperated by the way the mainstream has been selective in its purpose. And who has been doing the leaking is a mystery as much as who has been filtering the stuff. The leak is the information but the flow is the message.
Of the 250,00 documents said to have been released by Wikileaks, fewer than a thousand have been released by the press. So where are the rest? Could it be true what American civil rights attorney Michael Ratner has been quoted as saying, that "in the recent disclosure, Wikileaks has only posted cables that were reviewed by the news organisations and in some cases redacted. The news organisations showed them to the Pentagon and agreed to some of the government's suggested redactions"?

But free things are a boon and we are children all who want to believe in Santa Claus. From the tittle-tattle of diplomats a world view is formed but information can be stranger than truth. And diplomats are people who sometimes believe six impossible things before breakfast. But all this has not come without its own in- built entertainment value though, and irony as large as an elephant in a circus. Who, for instance, would think that US diplomats at large would rail against the absence of human rights, due process and the like when their mother country is waterboarding people and holding them without due process in a large internment camp and sending them hither and thither for "extreme rendition" abroad?

The information that has been coming out has brought some gems from their thoughts. Irony plays no small part of that, and also some big question marks. Who is this strange man Assange, for instance, and who has been paying for his meals as he was flitting from one place of refuge to another before his post-court appearance on a snowy night in England? And what a delicious thing irony can be as came from the mouth of Assange's lawyers - who were speaking on his behalf presumably - that some naughty people have been leaking details of the rape and sexual assault allegations against him in Denmark.

We don't know what that Norwegian daily will make of that new cache of information now that they have got it but it looks now that this saga of revelations will continue ad nauseam and anon.

Which brings us back to bananas that I mentioned last week in my bafflement about the strange journey of our modest petai beans. I have received emails from people who have confessed that they too were taken in by the weird and wonderful claims made for the petai and indeed have themselves passed the message on to take in more people into this smelly brotherhood.

I have no message of disdain against the petai which I am sure does have some very good attributes but what alarms me is how easily information can gather speed on the Internet and metamorphose into another thing that dances on your computer screens in a new coat. The petai in the cod message is said to build stamina, give you loads of potassium and keep your brain and mind awake. This paean to the petai that appeared in the LISTSERV of Syracuse University under the name of a Malaysian professor even appeared verbatim in Yahoo! Answers but without the professor's name. The petai praises, as I found from further tracing, were actually plagiarised from something called "The Amazing Banana", with "petai" inserted in place of the "banana" and it fooled many people and was picked up even by seemingly prestigious websites.

I traced the original banana article to a website run by a group with the delightful name of Scion of Zion and I mentioned that I could not get any reply from them. An email has landed from one Dr Ken Matto of Scion of Zion with this message: "I placed that article about the banana on my site back on Feb 24, 2004 so to be honest I have no idea which health site I got it from. This I do know that the article on my site is not the original but it may be copied from the original."

FED: Sea Patrol keeps on rolling

SYDNEY, April 12 AAP - Navy action drama Sea Patrol returns for a fourth series this
week, and if producers and actors have their way it'll keep going for at least another
six years.

Original cast member Ian Stenlake, who plays commanding officer Mike Flynn, says he's
delighted the show has maintained its success over the years.

He'd like to see it keep going, with producers and writers having mapped out a 10-year
plan for the series.

"That would be awesome," Stenlake told AAP.

"It would be very difficult to leave. It's such a good time to be involved."

Also starring Lisa McCune, the series set aboard a fictional Australian naval vessel,
HMAS Hammersley, has been a solid ratings winner for the Nine Network.

Stenlake says he believes audiences have kept tuning in year after year, because the
series is "completely unique" but not "far fetched" - largely thanks to assistance from
the Royal Australian Navy.

"They have a major input," Stenlake says.

"Right from the script development, right from the start, there's someone with the
writers the whole time."

On occasion, Stenlake admits the navy has stepped in to stop some stunts, but he says
the TV crews are very respectful of its authority.

"We have a navy liaison on set every day, and we can always make phone calls if we
need to, which we do," he says.

"Because we want to represent these guys as accurately as possible, without forgetting
the fact that it's drama, and we can take licence occasion."

The upcoming series, which moves from Mondays to the Thursday 8.30pm timeslot, was
shot over five months, near Mission Beach in far north Queensland and on the Gold Coast.

The series has been extended by three episodes to 16 and will introduce three new cast
members including former Home and Away actor Conrad Coleby, who plays Petty Officer Dylan
"Dutchy" Mulholland.

Stenlake, who's been with the show from the beginning, says he believes this series
is better than ever.

"Series four, it's just bigger, it's better, and I don't know how but we managed to
have a lot more fun," Stenlake says.

"We've had some brilliant people come and work with us, and I think it looks good, too."

Qld: Patel friend stands by surgeon as case goes to trial

BRISBANE, April 21 AAP - A friend of surgeon Jayant Patel, who has been committed to
stand trial in Queensland over the deaths of three patients, says he believes justice
will prevail in the case.

Patel, 59, faces trial next year on 13 charges including three of manslaughter relating
to his time as director of surgery at Bundaberg Base Hospital between 2003 and 2005.

He was bailed and committed to stand trial in the Supreme Court on Monday at the conclusion
of a lengthy Brisbane Magistrates Court hearing.

Texas-based surgeon Dr Vijay Mehta, who has maintained a website seeking justice for
Patel, says he stands by his friend.

"I do stand by him and my conviction that we should not criminalise surgical care,"

Dr Mehta told AAP.

He said he was happy that much of the emotion had been taken out of the case.

"Justice cannot prevail if there is too much emotion and prejudging the action of a
person, especially if the person charged is of different ethnicity and nationality and
victims are local," he said.

"He was the easiest scapegoat for the politicians and they have milked that cow to the extreme.

"I am hoping for the best."

NSW: P-plater killed while taking car for first drive: police

SYDNEY, Dec 16 AAP - A Sydney P-plater has been killed while taking a car he was restoring
for what's believed to have been its first drive, police say.

The 24-year-old man was killed after his unregistered car ran off the road and into
trees at Newport, on Sydney's northern beaches, police said.

He took the 1971 model Datsun 1600 - which he had been restoring - for what's believed
to have been its first drive about 6pm (AEDT) on Monday.

As the car was travelling west along Crescent Road, the driver lost control, causing
the vehicle to run off the road and crash into two trees, police said.

The man was airlifted to Royal North Shore Hospital for emergency treatment of multiple
injuries but was pronounced dead on arrival.

A 20-year-old man, who was a passenger in the vehicle, was taken by ambulance to the
same hospital for treatment of superficial injuries and had since been released, police
said on Tuesday.

Initial inquiries suggested speed was a factor, police said.

Fed: Strong CAPEX to give much needed lift to GDP

CANBERRA, Aug 30 AAP - Strong capital expenditure by businesses in the June quarter
will provide a much needed injection of growth to next Tuesday's gross domestic product
(GDP).

New private capital expenditure rose by a seasonally adjusted 6.3 per cent in the June
quarter to $20.897 billion, from an upwardly revised $19.717 billion in the March quarter,
data released today by the Australian Bureau of Statistics (ABS) shows.

This was much stronger than economists' median forecast for a rise of two per cent.

However, the ABS said the current account deficit was $15.988 billion in the June quarter
from an upwardly revised $15.545 billion in the March quarter.

Economists had been looking for a deficit of $15.7 billion.

Another tepid exports performance will detract 0.1 percentage points from GDP, although
this was not as weak as some economists had been expecting.

Prior to this week's data, economists' forecasts had centred on a relatively slim 0.5
per cent increase in gross domestic product (GDP) after sharp 1.6 per cent acceleration
seen in the March quarter.

Such a GDP outcome would see the annual GDP growth rate slip to 3.7 per cent from 3.8
per cent in the year to March.

These forecasts were based on retail trade during the June quarter having slumped to
its lowest level since September 2000.

However, construction work data released yesterday also proved unexpectedly weak, possibly
cutting 0.2 percentage points from growth, according to one economist.

A parents' group says the federal government should subsidise the cost of sending children
from remote areas to boarding school .. to improve their educational prospects.

Isolated Children's Parents Association president JACK BEACH says time's running out
to improve education for kids from the bush .. who have limited subjects on offer and
limited choice of schooling.

He's warning many students in remote areas are missing out on the education opportunities
their city cousins have.







Mr BEACH's comments come ahead of a conference in Albury this week examining the challenges
facing rural education.

The forum .. hosted by the Foundation for Rural and Regional Renewal .. will come up
with priorities and recommendations for improving educational opportunities in remote
parts of Australia.

Professor MARGARET ALSTON .. who heads Charles Sturt University's Centre for Rural
Social Research .. says inaccessibility to schools and unis in rural areas is threatening
to become a national embarrassment.

She's predicting these problems .. coupled with drought and the increasing cost of
education .. will cause young people in rural Australia to fall further behind those
in city areas.

She says children who have to travel long distances or leave their home towns to be
educated face severe disadvantages.

Federal Education Minister JULIE BISHOP's expected to speak at the conference tomorrow.

Fed: Blood feud not good enough to win refugee protection

CANBERRA, Dec 14 AAP - Fear of getting killed in a 60-year-old Albanian blood feud
did not qualify a person for refugee protection in Australia, the High Court has ruled.

High Court judges by a majority of 4-1 today dismissed an appeal lodged by an Albanian
man, named only as STCB, who in November 2000 applied for a protection visa.

That was based on his claim that in 1944-45 his grandfather sparked a blood feud by
killing a member of the Paja family.

He said the Pajas were obliged by the customary law of Albania to kill a male member
of STCB's family.

He feared he would be killed if he returned to Albania and Albanian police were powerless
to intervene.

The Immigration Department refused his application. He then appealed to the Refugee
Review Tribunal (RRT) which affirmed that decision.

The tribunal accepted STCB's claim that his family was involved in a blood feud with
the Paja family and that there was a tradition of blood feuds, particularly in northern
Albania.

However, Albanian authorities were addressing the problem.

The RRT held that fear of revenge for a criminal act did not qualify as fear of persecution
falling within the definition of persecution in the Refugees Convention.

Undeterred, STCB then turned to the Federal Court and the Full Court of the Federal
Court which both upheld the RRT decision. He then appealed to the High Court.

Judges today found his grandfather had a fear of persecution, not for any reason listed
in the Refugee Convention, but because he committed murder and that was the only reason
for STCB's concern.

Fed: Tax office faces paying legal costs in lost cases

CANBERRA, Aug 7 AAP - The tax office faces paying the legal costs of taxpayers who
enjoy a courtroom victory under proposals put to the federal government.

The Inspector-General of Taxation, David Vos, also believes the tax office needs to
clearly outline its approach to litigation, with a focus on resolving disputes fairly,
quickly and in a cost-effective manner.

It follows a report by Mr Vos which reviewed how the tax office managed litigation,
including an evaluation of test cases.

The report was prompted by concerns that the tax office pursued court action in inappropriate
cases, that in some cases the court action argued points which had already been ruled
upon and that the tax office used selective precedents to argue its point.

There had also been concerns that taxpayers were often unable to access funding for
test cases which are often used to test tax office rulings.

Mr Vos, in his main recommendation, said the tax office had to set out a corporate
philosophy which committed the organisation to resolving litigation quickly and fairly.

Such a philosophy would also commit the tax office to administering tax laws as enacted
by parliament, and interpreting those laws in an impartial and transparent manner.

In another recommendation, Mr Vos said taxpayers' expenses in defending cases, where
the tax office is unsuccessful, should be covered by the tax office.

The government has agreed to ask the Treasury Department to work with the tax office
and the Attorney-General's Department on coming up with guidelines to cover taxpayers'
costs.

The government will also provide a right of review by a Treasury-headed body that will
look at test case funding decision taken by the tax office.

Tax Commissioner Michael D'Ascenzo said he was happy with the report, saying it had
found test case litigation was important and should be continued.

"We agree with most of the recommendations in the report and will implement them accordingly,"

he said.

"There is always room for improvement in our performance and these reports assist us
to ensure the effectiveness and transparency of the revenue system."

Mr Vos has supported the creation of a single area within the tax office that will
have responsibility and authority over all aspects of tax office litigation.

Opposition foreign spokesman KEVIN RUDD says Australia should continue to lobby support
for the indictment of Zimbabwean President ROBERT MUGABE.

Mr RUDD has met with Zimbabwe's opposition justice spokesman DAVID COULTARD, who is
building support for an action against MUGABE in the International Criminal Court.

Zimbabwe has recently been condemned by the United Nations and the West for its so-called
urban cleanup drive that has seen the demolition of shanty towns where thousands of Zimbabweans
live.

Mr RUDD's told ABC radio that Australia should support the bid for an action through
the UN Security Council to get MUGABE indicted, and lobby other countries to the same
end.

Prime Minister JOHN HOWARD says he can't stop former Guantanamo Bay detainee MAMDOUH
HABIB from being paid to do a television interview.

But he says the government is keeping its options open until after Mr HABIB's interview
is aired on the Nine Network's Sixty Minutes program on Sunday.

It'll decide then whether any money paid to him can be seized.

Mr HABIB was released without charge from the US prison at Guantanamo Bay in Cuba and
returned to Australia more than three years after being detained on suspicion of being
a terrorist.

Mr HOWARD's told radio 3AW he has no advice that the reported $200,000 payment to Mr
HABIB is illegal.

Under Australian law, the proceeds of selling a story can be seized if the recipient
is profiting from a crime, including terrorism.

Gardening Resources on the Web.(News Briefs)

Gardening is America's number-one leisure activity, enjoyed by one in three adults. Why do we garden? Survey responses suggest we like being active and out of doors, we garden to relax, and we find creative expression in the "slowest of the performing arts." While this hobby needn't be expensive, Americans collectively spend $30 billion a year on their lawns and gardens.

In the Pennsylvania Horticultural Society's McLean Library we work with amateur gardeners who want to learn the art and science of horticulture. Like similar libraries, we answer thousands of garden-related inquiries each year. As is true of all libraries, we routinely use and recommend informative Web sites.

This article's Web resource list is not exhaustive. There are too many gardening sites to note every good one. Instead, I've limited this article to resources we've used or recommended to gardeners. The sites are mostly in the U.S., with a nod to Canada and the U.K.

These resources are for gardeners. Related topics, such as botany, plant sciences, and landscape architecture, deserve separate treatments, so we did not include them.

Gardening Is Regional

The Web is global but growing conditions are local, subject to variations of soil, temperature, light, and water. How do gardeners know which plants will grow in their back yards? To begin, they must understand "hardiness," a plant's likelihood of surviving winter's cold or summer's heat. Hardiness zones are "climactic zones established for the purpose of classifying plant hardiness" (Complete Gardener's Dictionary, Barron's 2000). Gardeners consult hardiness zone maps to verify which plants can live in their garden. The most commonly used U.S. map is the U.S. Department of Agriculture's Hardiness Zone map, which divides North America into 11 zones, with zone 1 in the north and zone 11 in the most tropical climes. The Naming of Plants

Like all living things, plants have "official" Latin names and common names. Common names often cause confusion. A Lenten Rose is not a rose by any other name at all -- it's a hellebore (Helleborous orientalis). So if you want to grow a Lenten Rose, it's futile to consult a rose book or Web site. Let's say you visit a nursery to buy a Cedar. Do you mean an Atlas Cedar (Cedrus atlantica)? Or a White Cedar (Thuja occidentalis)? When in doubt, crosscheck a common name with its Latin name and read the plant description carefully. Latin names are harder to spell than colloquial names, so when you search the Web with Latin names, have a good horticultural (printed) reference handy if you can, such as D. J. Mabberley's The Plant-Book (Cambridge University Press, 1997).

Gardening Niches

Gardeners' interests can be described two ways: what they grow and where they garden. Many gardeners have plant passions, such as herbaceous perennials or native plants. Some specialize in one plant -- roses, orchids, or rhododendrons, for example. Plant societies, whose members are knowledgeable hobbyists, foster the growing, collecting, swapping, or sale of prized plants. Many plant societies have informative Web sites. Where gardeners garden is equally diverse: on city rooftops, in containers, or indoors; on country estates, deserts, or by the seashore. Some garden alone; others like the camaraderie of community gardening.

What Do Gardeners Want?

What information do gardeners seek? Our reference logs reflect their most common concerns:

* Diagnostic -- something is wrong with a plant. Need to identify pests, diseases, environmental situations, and recommend solutions.

* Plant identification -- what plant is this?

* Right plant, right place -- gardener needs plants appropriate for situation, i.e., shade plants or seashore plants or plants for slopes, etc.

* Cultivation information -- how to grow, care for, and propagate the plant.

* Where to buy plants -- especially ones not locally or easily available.

* Garden travel -- which gardens to visit and best time to visit.

* Where to learn more -- where to take classes, attend lectures, join a plant society; book recommendations; Web site recommendations.

* How to research historic landscapes -- user needs period garden designs and plants.

Not surprisingly, gardeners seek the same information on the Web.

In our Internet classes on gardening resources we emphasize that most reliable plant and garden information still exists in print form. Web resources are merely one part of horticultural information.

Databases for Cultivated Plants

This is a weak area on the Web. While such databases do exist, to date, none are as comprehensive as books in a basic gardening library. Authority, too, is a problem. When I consult The New RHS Dictionary of Gardening, I know an army of botanists and horticulturists oversaw its creation and the world's most respected horticultural society -- the Royal Horticultural Society -- produced it. Who created the records for NeoFlora [http://www.neoflora.com], which claims to be "the world's largest plant database"? NeoFlora is vague about this. How does NeoFlora add new entries? By asking gardeners to submit records to it. While cooperative database-building does work (witness OCLC's WorldCat), is this the best way to grow a plant database? Who will solve thorny taxonomic questions? Where is quality control? (Think catalogers are fussy? Talk to a taxonomist!) That said, The New RHS Dictionary sells for $312. NeoFlora is free.

The site divides into topics, images, links to related sites, and tools. PLANTS can generate reports of invasive and noxious plants, for example, the bane of all gardeners.

The Garden Conservancy

The Garden Conservancy is the U.S.' only national nonprofit organization dedicated to garden preservation. CBHL is an international organization of botanical and horticultural librarians, botanists, book dealers, and collectors. This site describes CBHL's activities and lists Web addresses of member libraries. Some, like Harvard's Botany libraries and the New York Botanical Garden library, are large research collections. Other libraries are smaller, but all share an interest in horticulture and botany. With in-depth collections reflecting local growing conditions, CBHL libraries serve as regional horticultural information centers. Of course, most of the reviews cover non-gardening material, so you should know key bibliographic information on the books you want to check -- title, author, etc.

Biographical Information

The most complete American reference to biographical information on landscape architects is the recently published book, Pioneers of American Landscape Design, Charles A. Birnbaum, Robin Karson, eds., New York, McGraw-Hill, 2000.

For me, a Web surprise was A&E Television Network's Biography Web site [http://www.biography.com]. Within 5 minutes of searching, I found brief but useful entries for a dozen historically significant plant people. This site's database combines entries from the Cambridge Encyclopedia and the Cambridge Dictionary of American Biography. My only quibble is that search is limited to name only -- no access by subject or date.

What are "Heirloom Plants"? The Complete Gardener's Dictionary (Barron's, 2000) defines heirlooms as "cultivated forms of plants that originated before 1940; hybrids only became common after World War II,, Heirloom plants, also called "historic" or "antique" plants, are often used in reconstructions of historic gardens and landscapes. A Google search with these terms will yield links about heirlooms and sources for them.

What's in short supply on the Internet? Good gardening writing. Like travel writing, garden writing can be a pleasure to read, with well-crafted, often inspired, writing. On the Web, you won't find much of Henry Mitchell, Vita Sackville-West, Andrew Jackson Downing, Allen Lacy, Katharine White, or Elizabeth Lawrence. But you can find the catalogs of garden libraries (like the CBHL libraries) and seek these authors there -- or perhaps dig them up in your own library.

Perry OKs Budget as Legislature Works On.(News)

DALLAS - Texas Gov. Rick Perry signed a two-year, $172.3 billion state budget Friday, but lawmakers continue work on two bills to finance the spending plan.

"I am proud Texas will continue to live within its means while encouraging job creation and maintaining essential services," said Perry, who is considering a run for the Republican nomination for president in 2012.

"There is still some work to be done by lawmakers, but I am confident the bills I have signed will strengthen our economic momentum moving forward," Perry said at the signing ceremony.

Work continues this week on a financing bill that would have provided $3.5 billion of non-tax revenue through accelerated collections and the deferral of billions in state aid to local education into fiscal 2014. The measure failed to pass in the regular session.

The special session is set to end June 29.

A companion bill would amend the Texas educational funding formula to account for $4 billion less in state spending than required under the current method.

An amendment to the school measure would allow bonds issued by charter schools with a high credit rating to qualify for enhancement through the state's Permanent School Fund.

The budget includes $257 million for two years of debt service on an additional $3.3 billion of Proposition 12 highway bonds.

The new debt, which would be issued by the Texas Transportation Commission, would exhaust the voter-approved capacity for the road debt program that's supported by the general fund rather than the gasoline tax.

The budget signed by Perry underfunds the state Medicaid program for poor and uninsured Texans by almost $5 billion. The bill funds the state-federal program at $10.2 billion in fiscal 2012 and $6 billion in fiscal 2013.

Legislative leaders hope state revenues will perk up enough to cover the budget gap with a supplemental appropriation bill when lawmakers meet again for a regular session in January 2013.

State Comptroller Susan Combs last week certified that anticipated general fund revenues of $78 billion in fiscal 2012 and 2013 would be sufficient to finance the budget developed by the Republican-controlled Legislature.

Combs said legislative exemptions to the sales tax and others cost the state $32.2 billion a year.

The Legislature approved the use of $3.2 billion from the state rainy-day fund to help cover a revenue gap in what remains of fiscal 2011, but the House balked at Senate plans to use $4 billion from the emergency fund to keep school funding at mandated levels.

The current version of SB 2, the appropriations measure, was amended in the House to allow some use of the rainy-day fund to cover some of the cuts to public education.

Revenues above the $6.5 billion expected to be in the fund at the end of fiscal 2013 would go to local education, to a maximum of $2.2 billion, to account for enrollment growth.

SB 1 contains a measure levying state sales taxes on Internet retailers with operations in Texas. Perry vetoed a similar bill that passed during the regular session.
